THE PROCESS

When the matter passes for examination (comes onto preparation), the transfer, bond and bond cancellation attorneys have 5 working
days from that day to hand in the deeds for execution and registration to occur the following day. The 5 days are provided to conveyancers to sort out any minor examiner’s notes that need to be addressed by the conveyancers before the matter can be handed in for execution and registration to occur the following day.

POTENTIAL DELAYS

Deeds Office internal process delays. Municipal rates clearance and/or body corporate levy clearance and/or Homeowners Association consent expiring before the transfer can register. Outstanding costs or occupational rent. Financially or contractually linked transfer not able to register simultaneously. Delay in obtaining the proceed to register from the buyer or seller’s bank. Tenants not evacuating the property where no agreement was reached to take over the tenancy. Registration dates not coinciding with moving dates and no agreement reached regarding earlier or later occupation.
