THE PROCESS
If it is a condition of sale that the kitchen is repainted or the roof repaired, for example, the transfer attorney needs to ensure that the Seller has obliged and that all the conditions have been fulfilled before the property may be transferred.

The Seller not adhering to the conditions timeously. If municipal plans are a sale condition, the municipality may not have up to date approved plans and the Seller may have to appoint an architect to draft them. The municipality may not approve them once drafted and the building will have to be adjusted to adhere to the municipality’s stipulations.
